A Kano State High Court has struck out the suit challenging the creation of 5 new Emirates in the State.
Alh. Bashir Othman Tofa & ors had challenged the state government on the creation of new emirates in the state.
The Presiding Judge, Justice N.S. Umar in his considered ruling on the preliminary objection filed by the State Attorney General, Ibrahim Mukhtar, on lack of the plaintiffs’ capacity to institute the action.
He also ruled that the suit is public interest litigation, and allowing the plaintiffs to continue with the action may amount to opening a floodgate of multiple actions.
The court upheld the objection.
